Terms & Conditions Current See Rewards Program 1. Members of WAKEUPNOW can join CurrentSee Rewards program by paying an annual membership fee within their first 30 days for $20. 2. CurrentSee Rewards is a Shopping Rewards Program where members can shop for great deals and earn Freedom Points towards their purchases. 3. CurrentSee Points are earned by joining CurrentSee Rewards and then by participating in our Receipt Program. 4. CurrentSee Points can be used to participation in our Auctions or to get Shopping Discounts on merchandise on our CurrentSee Rewards website. Wake Up Now members can choose a Reward that will be applied to their Wake Up Now Currentsee Card, (only one membership per household can be applied, to Wake Up Now Currentsee Card, and member must meet Wake Up Now requirements. (see below for more details) . All other earned Rewards will be applied to Freedom Points. 5. Once you have paid your registration fee, 50 Freedom Points will be added to your account. 6. To start your enrollment, you can go to your Wake Up Now Back Office, follow the link to "CurrentSee Rewards Signup" register and pay online, or register on our website at, www.freedomnowrewards.com . After completing your online registration, print and mail the Registration Submission Form (RSF) and W9 form to: 360 Marketing Pro, LLC, 3540 W. Sahara Ave Bldg #E6 Suite 1450, Las Vegas, NV 89102. 7. If you want to pay by check, you still need to register online. Print your Registration Submission Form and W9, make check payable to: 360 Marketing Pro, LLC and mail to: 360Marketing Pro, LLC 3540 W. Sahara Ave Bldg #E6 Suite 1450 Las Vegas, NV 89102 8. Your Registration Submission Form must be postmarked no later than 10 days from the date you registered online if you want to participate in the receipt program. 9. If you are mailing multiple Registration Submission Forms, they need to be mailed in separate envelopes. 10. You can start collecting receipts and earning more Freedom Points from the day you register online until the following month's deadline. 11. To start saving and using Freedom Points towards the purchase of our great deals, collect receipts from our Premier Retail Partners and follow the guidelines for "Accumulating More Freedom Points". 12. To have your receipts applied towards your WAKEUPNOW Currentsee Card, collect receipts from our Premier Retail Partners and follow the guidelines for "Applying Rewards towards your Currentsee Card" (see below). 13. Refund/exchange/cancellation or applicable warranty policies-- All Sales are final on membership, merchandise or travel deals that are purchased from the Freedom Now Rewards Shopping Program at www.freedomnowrewards.com . The terms and conditions posted on the website are the current terms and conditions which take precedence over any terms and conditions specified on any verbal or printed materials. Guidelines for Accumulating More Freedom Rewards Points,or Applying Reward towards a Wake Up Now Currentsee Card: 1. Members that want to participate in the Receipt Program need to Register and pay the annual Registration fee. 2. Download and mail the W-9 Form (If W-9 Form does not load after Registering, you can download the W-9 form from our website, on the "About US" page, and fill it out and mail it to: 360 Marketing Pro, LLC. (see due date on line 7 above) 3. Each month collect receipts from the 1st day of each month, until the 25th day of the month from the list of our Premier Retail Partners. Collect a total of $200 in original and legible receipts in any combination of food, fuel or other merchandise, excluding taxes, to earn 50 Freedom Points or collect a total of $100 in original and legible receipts in any combination to earn 25 Freedom Points, ($100 in receipts can only earn Freedom Points. Cannot be used towards a Currentsee Card Reward). 4. More points can be accumulated by banking rewards each month. If you bank rewards for three (3) months in a row, an additional 100 points will be added to your account at the end of your third month of receipts submission and approval. 5. They only restrictions on what you buy is NO GIFT CARD purchase receipt. Other than that you must use one of our Premier Retail Partners. (For a updated list to all our Premier Retail Partners, you can view on our website.) 6. All collected monthly receipts can be scanned and emailed as a jpeg or a pdf file, by the "due date" for that submission period, which is on or before the last day of that month, and not before the 25th of each month, to memberservices@freedomnowrewards.com . You can download a "Submission Form" from our website "About Us" page. Make sure to include your email address, your name and your WAKEUPNOW membership ID. Once scanned and emailed to us, you do not have to mail or send in the paper receipt, if you are banking your Reward to shop on our website. However, if you cannot scan your receipts, or you want to apply your Reward to your Wake Up Now Currentsee Card, you will need to mail them to us with a copy of a "Receipt Submission Form". 7. After email is received by Freedom Now, you will receive an email confirmation of our receiving your receipts. Freedom Points will be added to your account within 5-7 days and available to use. 8. When mailing your monthly receipts, your envelope must be postmarked by the "due date" for that submission period, which is on or before the last day of that month. There is a 14-day grace period from the last day of the month to make certain your submission arrives and is postmarked correctly. This 14-day grace period is provided as a courtesy due to the unforeseen mail delivery time from your area to our office. 9. If mailed, we will email you when we receive your paper receipts and it will take us up to 14 days to process your receipts. You will also receive an email letting you know when your paper receipts have been approved. If you learn that your submission has not been accepted due to incomplete information, you will have 15 days from the date informed to provide the missing information so your submission can be corrected. 10. Receipts must be redeemed within the month stated on each receipt. 11. The receipts submitted each month must be the original and legible receipts for that month. Receipts from the wrong month will not be accepted. Photocopies of receipts also will not be accepted. 12. The monthly receipts must also include the store name and date, except where prohibited by law. If the receipt is illegible, you may handwrite the name of the grocery store and the date on the top of the receipt. 13. Points have no dollar value and cannot be redeemed for cash. 14. Once Reward becomes Freedom Points, you cannot apply points towards your Wake Up Now Currentsee Card. 15. To qualify for the Currentsee Card Reward you must meet Wake Up Now's requirements of loading up your Currentsee Account and getting your Blue Line Review completed. For more information on these requirements, contact Wake Up Now. 16. If you do not meet your Wake Up Now requirements, your mailed in receipts will be banked for Freedom Points that month and each month until Wake Up Now notifies Freedom Now Rewards of your "Qualified Member Status". 17. If you are a "Qualified" Wake Up Now member and after receipts have been qualified, your Currentsee Card Reward will be applied 6 weeks from the date that we qualified your receipts. 18. If you miss a month or do not send in receipts in any given month, you can start participating again and send in receipts to earn a reward. Shopping, Bidding and General Terms & Conditions. The following General Terms and Conditions shall apply exclusively to the business relationship between 360 Marketing Pro, LLC, its internet platform www.freedomnowrewards.com ("Freedom Now Rewards") and our users. By using Freedom Now Rewards, the user accepts the following General Terms and Conditions, Variations or alterations. Any special promotions run by Freedom Now Rewards shall only be valid if they are announced on Freedom Now Rewards' website or in its corresponding email, and or email newsletter. Certain promotions may only be valid for a limited time, and details of any such timing will be announced on the website or in a email and or email newsletter. Once the advertised time limit of any such promotion has been reached, or the relevant auction or auctions have ended, the promotion is also finished. Any bidding advice or other written materials (for instance, 'Help' articles) posted on Freedom Now Rewards are provided solely as suggestions and are not intended to be relied upon. Freedom Now Rewards is not liable or responsible for any actions taken due to a user or other person having read or been told about such advice or other written materials. 1. Eligibility to Participate/Registration with "My Freedom Now Rewards"/Disqualification By placing a bid on Freedom Now Rewards, the user declares that they are legally capable of entering into binding contracts and that they are at least 18 years old. Freedom Now Rewards' products and services are offered exclusively to private users and not to commercial or partly-commercial resellers. Freedom Now Rewards reserves the right to exclude commercial resellers from the participation in the auctions and to close their user accounts at any time. Each user may register only once per "Referral ID", if user has one, or by using their postal address (registration using PO Boxes or equivalents is not permitted). Additionally, only one user registration per household is permitted without a "Referral ID". During the registration process, the user must choose a username. The username must not be offensive, be selected to deceive or mis-inform other users, may not offend common decency or infringe upon the rights of third parties. If Freedom Now Rewards receives information of a username which is illegal or in breach of these Terms, this username can be amended by Freedom Now Rewards without prior notice. The corresponding user password is to be kept secret by the user. User accounts created during registration are non-transferable. The user account may be used only by the user and not by anyone else. Any abuse of the user account, be it to the detriment of third parties or to the detriment of Freedom Now Rewards, shall result in the disqualification of the user and the reporting of a crime. In general, the user shall be liable for all activities that are undertaken using the user account together with the associated password. Freedom Now Rewards reserves the right to temporarily or permanently disqualify a user, or disable their account at any time, and at its sole discretion. Users will be disqualified when in the reasonable opinion of Freedom Now Rewards; a member has violated any laws or the rights of third parties. A user will be disqualified if such action will protect the rights of other users, or to prevent unauthorized manipulation or use of Freedom Now Rewards. Examples of such unauthorized usage include (but are not limited to) non-payment of bids, use of unauthorized third-party bidding software or set up of multiple user accounts by the same individual. In case of a breach of these Terms, Freedom Now Rewards reserves the right to withhold deliveries or refunds for bids. Furthermore, Freedom Now Rewards reserves the right to limit the number of auctions a user may participate in or the number of his successfully finished auctions at its sole discretion. Please refer to our separate acceptable use policy for additional information. 2. Bid Purchasing for Online Bidding / Payment / Validity of Bids Bidding rights, so-called "bids", must be purchased and paid for by users prior to online bidding. Bids can be purchased in packages, through one of our charities, at the currently applicable prices, which can be viewed by "clicking on one of our sponsored charities". Payment can be made by using saved FR Point or by using a credit/debit card or via payment agents such as PayPal account. Should a payment not be honored by a user, a returned payment fee will be charged. The user will be responsible for these fees. Freedom Now Rewards reserves the right to block access to the user's account until payment in full of the invoice amount, including any fees due to returned payment etc., and to withhold any outstanding deliveries until payment is received in full. Bids purchased are non-refundable. Bids placed on auctions are no-refundable. Winning bid is a binding agreement to purchase the item at the winning bid price. Bids are valid for one year after they have been credited to a user's account. Free Bids are only valid for the time stated in the promotion, in general only 7 days. Upon expiration, they become void and can no longer be placed. Once Bids are purchased, there is no refund. Refunds will not be issued for Bids placed in an auction, expired Bids, Voucher Bids and Free Bids. For further information on refunds please see clause 7: Returns and Cancelations). 3. Bidding User must be logged in to participate and bid on an Auction. Bids can be placed by clicking on the relevant bid buttons The user is prohibited from using bidding software not authorized by Freedom Now Rewards, and doing so will result in immediate disqualification from use (see clause 1: Eligibility to Participate). 4. How the Screamin' Deals Auction Work With each bid placed the price of the item on which the user is bidding increases by the amount specified. A bid submitted by the user constitutes willingness of a user to enter into a binding contract with Freedom Now Rewards and in the event of a successful finishing of an auction, the claim to receive a purchase offer for the item of the auction under the conditions set out in the related auction. A contract to purchase the item does not come into effect until the auction is finished and the last bidder has followed all the steps as set forth in clause number 6. Each new bid resets the 'remaining time' for an auction up to, but not above, the displayed countdown reset value (usually, 10, 15 or 20 seconds). The auction ends when the remaining time reaches zero. The user who was the last to bid then wins the auction. All other bids placed on the item expire and will not be credited back to the user's account or be eligible for a refund. The last bidder is determined based on the records in Freedom Now Rewards database and Freedom Now Rewards decision regarding who is the last bidder shall be final (save in the case of manifest error). 5. How the Merchandise Meltdown Auction Works Merchandise Meltdown is a Dutch Auction. A Dutch Auction is a type of auction where the auction begins with a high asking price which is lowered until some participant is willing to accept the auction price, or our predetermined reserve price is reached. The winning participant pays the last announced price. This is also known as a "clock auction" or an open-outcry descending-price auction. Each Merchandise Meltdown Auction will start at full MSRP (Manufactures Suggested Retail Price). In a pre-determined timeframe the price of the product will continue to decrease in dollars, until all products in that Auction are sold. User can press the "M&M Buy" button at time or price as the amount goes down. Price will continue to go down till merchandise is at.àµ‰ cent" or till "Sold Out" shows and Auction is closed. Item will be quantity on hand and quantity number will not be disclosed. Auction could be for 1 or for 100 of same item. User must decide at what price point they want to buy the item, the lower the price goes, the greater chance the item will sell out. A bid submitted by the user constitutes willingness of a user to enter into a binding contract with Freedom Now Rewards to purchase said merchandise at price point user has chosen. Even when price continues to go lower, user cannot cancel or refuse to pay for product purchased at the time M & M Button is pushed. 6. Acceptance of the Win Payment after an auction has ended, the last bidder ("winner") or in the case of a Merchandise Meltdown purchase, User must go to "My Account". Here, information such as total price (including shipping costs) and payment options will be displayed. The user must actively confirm and pay the total price (end price plus shipping costs) for the win by following the steps indicated on that page or elsewhere on the website. Once the winner has clicked on the confirmation button the win is accepted. If an auction win has not been confirmed and paid within 5 days of the auction end date, Freedom Now Rewards reserves the right to withdraw the offer to conclude a contract and the winner's right to pay for and receive delivery of an item will be permanently revoked. All bids placed in that auction expire and are non-refundable. The user must pay the total price when confirming the win. After confirming the win and paying the amount due, the winner will receive a confirmation e-mail. The item will not be sent to the user until the total price has been paid to Freedom Now Rewards. A similar requirement for delivery is that all bids purchased and used by the user have been properly paid for. Should bids that have already been purchased and used not have been paid for, payments received shall be viewed as payment toward the bids not yet paid for, and we reserve the right to retain the item purchased at auction until all bids and the total price have been paid for in full. Freedom Now Rewards reserves the right to charge the winner reasonable storage charges for items not paid for. An invoice containing the auction price and shipping costs will be sent to the user by Freedom Now Rewards once delivery has been arranged. 7. Returns and Cancellations Refund/exchange/cancellation or applicable warranty policies-- All Sales are final on membership, merchandise or travel deals that are purchased from the Freedom Now Rewards Shopping Program at www.freedomnowrewards.com. In the event of defective merchandise, please email us at: memberservices@freedomnowrewards.com or call customer service at 702-772-5655 for information on product returns and return shipping number. In order to complete a valid return for defective merchandise, a user must contact customer service within 30 days of product received to acquire a return shipping number. Return the received product or products in original packaging and product box. Upon Freedom Now Rewards' receiving product return, product will be inspected for cause of damage. If product is found to be damaged by user and not a product defective, product will be returned to user and user agrees to pay a return postage fee or fee will be charged to users account. Should Freedom Now Rewards incur additional costs for insufficient postage on the return or for courier shipments and other irregular shipping methods that are over and above postal shipping costs, these costs will be deducted from any payment whatsoever remitted by the customer. Sets/boxes can only be returned in their entirety. Refunds approved will only be remitted in the form of a check to the account user and address on record. 8. Delivery Unless otherwise stated, delivery will be made directly from our suppliers or from our warehouse to the address provided by the user. Deliveries are made solely within the 50 states of the United States (explicitly excluding the U.S. sovereign territories of Guam, Puerto Rico and the U.S. Virgin Islands). Some restrictions or higher shipping costs may apply if the delivery address is in Alaska or Hawaii, please check notifications on the detail pages of the auctions in advance. Delivery times vary and any delivery time indicated is provided only as a guide and is not guaranteed. Freedom Now Rewards shall be entitled to involve third parties to satisfy its contractual obligations without being required to notify the buyer. Obvious damage to the item from transport or packaging damaged during transport is to be reported to Freedom Now Rewards upon taking delivery. Should Freedom Now Rewards not be able to deliver the item ordered, Freedom Now Rewards shall be entitled to substitute the item with a comparable replacement product with the same or better features, or provide a refund of the auction end price to the user based upon the user's preference. 9. Offsetting / Withholding Payment / Retention of Title The user shall only have the right to offset if his or her counterclaims are not disputed by Freedom Now Rewards. The user is not entitled by reason of any alleged minor defect to withhold more than a proportionate amount of the sum due. The item delivered shall remain Freedom Now Rewards' property until payment is received in full of the total price, including for the bids used in the auction. Until such time as payment has been made in full the user undertakes to store the item separately from their other possessions and to insure it. 10. Disclaimer of Warranty and Limitation of Liability regarding the Use of Freedom Now Rewards. USER EXPRESSLY AGREES THAT USE OF FREEDOM NOW REWARDS INTERACTIVE IS AT USER'S SOLE RISK. NEITHER 360 MARKETING PRO, LLC, FREEDOM NOW REWARDS, ITS AFFILIATES NOR ANY OF THEIR RESPECTIVE EMPLOYEES, AGENTS, THIRD PARTY CONTENT PROVIDERS OR LICENSORS WARRANT THAT FREEDOM NOW REWARDS WILL BE UNINTERRUPTED OR ERROR FREE; NOR DO THEY MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF FREEDOM NOW REWARDS, OR AS TO THE ACCURACY, RELIABILITY OR CONTENT OF ANY INFORMATION, SERVICE, OR MERCHANDISE PROVIDED THROUGH FREEDOM NOW REWARDS. FREEDOM NOW REWARDS IS PROVIDED ON AN "AS IS" BASIS; TO THE MAXIMUM EXTENT PERMITTED BY LAW, FREEDOM NOW REWARDS DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO ANY INFORMATION, SERVICES, PRODUCTS AND MATERIALS, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, FREEDOM FROM COMPUTER VIRUS AND IMPLIED WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE. IN ADDITION, FREEDOM NOW REWARDS DOES NOT REPRESENT OR WARRANT THAT THE INFORMATION ACCESSIBLE VIA THE SITE IS ACCURATE, COMPLETE OR CURRENT. WE ARE NOT RESPONSIBLE FOR TYPOGRAPHICAL ERRORS. IN NO EVENT WILL FREEDOM NOW REWARDS, OR ANY PERSON OR ENTITY INVOLVED IN USE OF A FREEDOM NOW REWARDS AUCTION, BE LIABLE FOR ANY DAMAGES, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE FREEDOM NOW REWARDS. USER HEREBY ACKNOWLEDGES THAT THE PROVISIONS OF THIS SECTION SHALL APPLY TO ALL CONTENT ON FREEDOM NOW REWARDS. IN ADDITION TO THE TERMS SET FORTH ABOVE NEITHER, FREEDOM NOW REWARDS, NOR ITS AFFILIATES, INFORMATION PROVIDERS OR CONTENT PARTNERS SHALL BE LIABLE REGARDLESS OF THE CAUSE OR DURATION, FOR ANY ERRORS, INACCURACIES, OMISSIONS, OR OTHER DEFECTS IN, OR UNTIMELINESS OR UNAUTHENTICITY OF, THE INFORMATION CONTAINED FREEDOM NOW REWARDS, OR FOR ANY DELAY OR INTERRUPTION IN THE TRANSMISSION THEREOF TO THE USER, OR FOR ANY CLAIMS OR LOSSES ARISING THEREFROM OR OCCASIONED THEREBY. NONE OF THE FOREGOING PARTIES SHALL BE LIABLE FOR ANY THIRD-PARTY CLAIMS OR LOSSES OF ANY NATURE, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, PUNITIVE OR CONSEQUENTIAL DAMAGES. NEITHER, FREEDOM NOW REWARDS, NOR ITS AFFILIATES, INFORMATION PROVIDERS OR CONTENT PARTNERS WARRANT OR GUARANTEE THE TIMELINESS, SEQUENCE, ACCURACY OR COMPLETENESS OF THIS INFORMATION. ADDITIONALLY, THERE ARE NO WARRANTIES AS TO THE RESULTS OBTAINED FROM THE USE OF THE INFORMATION. 11. Disclaimer of Warranty and Limitation of Liability regarding Purchases from Freedom Now Rewards: All new products are sold with the manufacturer's limited warranty only. Freedom Now Rewards warrants solely that the products sold to user under these terms shall have the characteristics specified in Freedom Now Rewards' specifications for such Products as set forth in the description of each auction and assumes no further warranties. The warranty period and service varies by manufacturer and product. The full text of any such warranty is available, free of charge, upon written request mailed to Freedom Now Rewards. Warranty is excluded for the delivery of any used Products. EXCEPT FOR THE WARRANTIES SET FORTH ABOVE FREEDOM NOW REWARDS MAKES NO OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, WITH RESPECT TO THE PRODUCTS, OR ANY RELATED SERVICES PERFORMED BY FREEDOM NOW REWARDS OR ANY OF ITS AGENTS OR SUBCONTRACTORS IN CONNECTION WITH ANY ORDER, INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, WHICH OTHER WARRANTIES ARE EXPRESSLY EXCLUDED AND DISCLAIMED. FREEDOM NOW REWARDS SHALL NOT BE LIABLE FOR PERSONAL INJURY AND PROPERTY DAMAGE RESULTING FROM THE IMPROPER HANDLING, MODIFICATION, MISUSE OF THE PRODUCTS BY THE CUSTOMER OR ANY OTHER PERSON FOLLOWING DELIVERY BY FREEDOM NOW REWARDS. IN NO EVENT SHALL FREEDOM NOW REWARDS BE LIABLE TO ANY PERSON FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS OR GOODWILL, LOSS-OF-USE DAMAGES OR ADDITIONAL EXPENSES INCURRED, WHETHER PURSUANT TO A CLAIM IN CONTRACT, TORT OR OTHERWISE AND WHETHER IN AN ACTION FOR BREACH OF WARRANTY OR OTHERWISE. 12. System Outage / Temporarily Halted Auctions A system outage has occurred if no bids can be submitted for items due to an unforeseeable disruption in a system. In such a case, auctions will be temporarily halted and the remaining times for the auctions, the current bidding price and the current highest bidder will be maintained. After the disruption has been resolved, the auctions will be continued and 10 minutes will be added to the remaining times for the auctions. Temporarily halted auctions are clearly indicated. Bids placed on a temporarily halted auction shall not be credited back on a user's account and are not eligible for a refund for bids used or other costs incurred. With the currently available technology, it is not possible to develop and operate computer programs (software) and data processing systems (hardware) completely without errors, or to rule out any unpredictable events in connection with the internet (hereinafter referred to collectively as "technical faults").
